Terms of Use

By visiting our websites or using the Services in any manner, you agree that you have read and agree to be bound by and a party to the terms and conditions of this agreement to the exclusion of all other terms. If the terms of this agreement are considered an offer, acceptance is expressly limited to such terms. If you do not unconditionally agree to all the terms and conditions of this agreement, you have no right to use the website or Services. Access to the website and use of Education Curb's Services is expressly conditioned upon your assent to all the terms and conditions of this agreement, to the exclusion of all other terms.

This Agreement applies to schools, school districts, and related entities and organizations, including but not limited to administrators, teachers, and professors who access or use the Services on their behalf (each an "Educational Institution"), as well as all non- Educational Institution visitors, users, and others, including students, their parents and legal guardians, who use the Services (such individuals and Educational Institution, collectively, "you"). If you're an Educational Institution additional Terms of Use will apply to you.

In this policy, we use "you" and "your" to mean grown-ups (parents, grandparents, guardians, etc.), not children under the age of 15. 
When we write "personal information", we're using the same definitions that the U.S. Federal Trade Commission uses in its Children's Online Privacy Protection Act (or "COPPA") rule. More information can be accessed here. 
Similarly, "verifiable parental consent" is a COPPA term, with specific rules about how to obtain it.
Now, here's what we do and how we do it:

ACCESS TO THE SERVICES
The http://educationcurb.com/ website and domain name and any other linked pages, features, Content, or application Services (including without limitation any mobile application Services) offered from time to time by Education Curb in connection therewith (collectively, the "Website") are owned and operated by Education Curb. Subject to the terms and conditions of this Agreement, Education Curb may offer to provide certain Services, as described more fully on the Website, and that have been selected by you (together with the Website, the "Services"), solely for your own use, and not for the use or benefit of any third party. The term "Services" includes, without limitation, use of the Website, any service Education Curb performs for you and the Content (as defined below) offered by Education Curb on the Website. Education Curb may change, suspend or discontinue the Services at any time, including the availability of any feature, database, or Content. Education Curb may also impose limits on certain features and Services or restrict your access to parts or all of the Services without notice or liability. Education Curb reserves the right, in its sole discretion, to modify this Agreement at any time by posting a notice on the Website, or by sending you a notice. You shall be responsible for reviewing and becoming familiar with any such modifications. Your use of the Services following such notification constitutes your acceptance of the terms and conditions of this Agreement as modified.

WE TRACK INSTALLATIONS
We work with partners to learn how people find our apps. This means that when you download our apps, we may learn that you came to our iTunes pages from a certain website (a review site, a web advertisement, our Education Curb web page, etc.). We may also collect a Facebook token if you are a Facebook user, but only to see whether you installed our app from one of our Facebook ad campaigns. We track installations only to understand how we can introduce more parents to our great products, and we make sure that our partners never use your personal information for any other purpose.

WE COLLECT PERSONAL INFORMATION THAT YOU GIVE US
After you install our app, we may ask you for certain personal information (e.g., your email address), and as you use our products, we may collect relevant personal information for transaction purposes (e.g., a mailing address to send you physical products that you purchase from us). We may also collect other personal information that you volunteer (e.g., if you email us with questions or suggestions, or if you post comments on public forum pages, our social-media outlets, etc). The only things we do with this information are personalize your experience and/or deliver products and Services to you.

WE MAY USE YOUR EMAIL ADDRESS TO HELP OTHER PEOPLE FIND OUR APPS
We try to show ads only to people who would be interested in our products; one way to do this is to show ads to folks who "look like" our current users. To find "lookalikes", our advertising partners may try to match email addresses of our current users with registered social-media accounts to learn that, for instance, our product is popular with people in their 30s with college degrees. In no case are individual details extracted or shared; the entire process is based on group characteristics, not individual characteristics. And as with all of our uses of your information, if you want us not to use your email address as part of this process, please let us know!

WE COLLECT INFORMATION THAT ISN'T "PERSONAL" AS DEFINED BY THE FTC
As children play with our apps, we record their responses in a variety of situations so that we can help parents understand their children's progress. This is not "personal information" as defined by the Federal Trade Commission, but we want to mention it here anyway to be as transparent as possible. We may share this information with researchers, but never in a form that would make it possible to identify particular children.

WE STORE PERSONAL INFORMATION SECURELY
We collect and store information (e.g., gameplay responses) both on your device(s) and on our own servers. When we send information across the network, we do so directly and securely. We have technical, administrative, and physical security measures in place to ensure that your personal information is safe. (We're parents, too, and our children's data are in there alongside yours!) But as we mentioned above, we cannot guarantee that no one will ever be able to break in.

WE NEVER DISTRIBUTE PERSONAL INFORMATION TO ANYONE
We will NEVER sell, rent, give away, or otherwise distribute ANY personal information we collect. That's not the business we want to build, and that's not how we want to treat our customers. We may work with partners occasionally, and when we do we will ensure that they adhere to every element of this Privacy Policy. And even if someday some other company acquires us, we will require that all data collected under this Privacy Policy remain protected by this Privacy Policy.

WE WILL ANNOUNCE ANY MATERIAL CHANGES TO THIS POLICY
If we ever make a substantial (i.e., "material") change to this Privacy Policy, we will reach out to customers in every way we can (e.g., email, push notifications on mobile devices, announcements within our products) to explain the changes and to offer customers a fresh choice about whether to accept the terms of the updated Privacy Policy.

WE WILL HONOR YOUR REQUESTS
You can always correct, update, or delete your registration with us, just by asking. You can also ask us to delete all gameplay information about your learners, remove your email address from our mailing list, etc. We're here to help you! SERVICES CONTENT
The Services and its Contents are intended solely for the personal, non-commercial use of Services by users and may only be used in accordance with the terms of this Agreement. All materials displayed or performed on the Services (including, but not limited to text, graphics, articles, photographs, images, illustrations (also known as the "Content," and which includes User Submissions (as defined below) are protected by copyright. You shall abide by all copyright notices, trademark rules, information, and restrictions contained in any Content accessed through the Services, and shall not use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purposes whatsoever any Content or third party submissions or other proprietary rights not owned by you: (i) without the express prior written consent of the respective owners, and (ii) in any way that violates any third party right.
The Services are protected by copyright as a collective work and/or compilation, pursuant to U.S. and Australian copyright laws, international conventions, and other intellectual property laws. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce (except as expressly provided in this Section), create derivative works based on, distribute, perform, display, or in any way exploit, any of the Content, software, materials, or Services in whole or in part.

You may download or copy the Content (and other items displayed on the Services for download) as part of our service for personal non-commercial use only, provided that you maintain all copyright and other notices contained in such Content. You shall not store any significant portion of any Content in any form. Copying or storing of any Content other than personal, noncommercial use is expressly prohibited without prior written permission from Education Curb or from the copyright holder identified in such Content's copyright notice.

If you link to the Website, Education Curb may revoke your right to so link at any time, at Education Curb's sole discretion. Education Curb reserves the right to require prior written consent before linking to the Website. 
In the course of using the Services, you and other users may provide information which may be used by Education Curb in connection with the Services and which may be visible to certain other users.

RESTRICTIONS
You as a user of the service warrant, represent and agree that you will not contribute any Content or otherwise use the Services in a manner that (i) infringes or violates the intellectual property rights or proprietary rights, rights of publicity or privacy, or other rights of any third party; (ii) violates any law, statute, ordinance or regulation; (iii) is harmful, fraudulent, deceptive, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable; (iv) involves commercial activities and/or sales without Education Curb's prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes; (v) impersonates any person or entity, including without limitation any employee or representative of Education Curb; or (vi) contains a virus, trojan horse, worm, time bomb, or other harmful computer code, file, or program. Education Curb reserves the right to remove any Content from the Services at any time, for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content or if Education Curb is concerned that you may have breached the immediately preceding sentence), or for no reason at all.

You are responsible for all of your activity in connection with the Services. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your right to access or use the Services. You may not post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any other user of the Services. Use of the Services to violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material (including material that may be considered threatening or obscene), or engage in any kind of illegal activity is expressly prohibited. You will not run Mail List, Listserv, any form of auto-responder, or "spam" on the Services, or any processes that run or are activated while you are not logged on to the Services, or that otherwise interfere with the proper working of or place an unreasonable load on the Services' infrastructure.

Further, the use of manual or automated software, devices, or other processes to "crawl," "scrape," or "spider" any portion of the Services is strictly prohibited. You will not decompile, reverse engineer, or otherwise attempt to obtain the source code of the Services. You will be responsible for withholding, filing, and reporting all taxes, duties and other governmental assessments associated with your activity in connection with the Services.
 You are responsible for all of your activity in connection with the Services. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your right to access or use the Services. You may not post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any other user of the Services. You understand and agree that Education Curb shall have the sole right to decide whether you are in violation of any of the restrictions set forth in this Section, and shall have sole discretion regarding the course of action to take in connection therewith.

FEES AND PAYMENT
You shall pay all applicable fees, as described on the Website and/or your account settings in connection with the Services selected by you. You shall be responsible for all taxes associated with use of such Services, including, without limitation any federal, state, local or foreign taxes or any sales or use taxes. Education Curb reserves the right to change its price list and to institute new charges at any time, upon notice to you, which may be sent by email or posted on the Website. Your use of the Services following such notification constitutes your acceptance of any new or increased charges. Any fees paid hereunder are non-refundable.
